1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Vindex Courier ("Company," "we," "us," or "our") governing your use of our courier, logistics, and delivery services, including our website at vindexcourier.com and any related applications.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

2. Services Description

Vindex Courier provides the following services:

  • Local and nationwide courier delivery
  • International shipping and freight forwarding
  • Import and export logistics
  • Express and same-day delivery
  • Package pickup and drop-off services
  • Warehousing and storage solutions
  • E-commerce fulfillment services

3. Account Registration

To use certain features of our services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Shipping Terms and Conditions

4.1 Shipment Acceptance

By tendering a shipment to Vindex Courier, you agree that the shipment complies with all applicable laws and regulations. We reserve the right to refuse any shipment at our discretion.

4.2 Prohibited Items

The following items are prohibited from shipping:

  • Explosives, firearms, and ammunition
  • Illegal drugs and controlled substances
  • Hazardous materials and chemicals
  • Perishable goods without proper packaging
  • Live animals
  • Currency, negotiable instruments, and precious metals
  • Counterfeit goods and items infringing intellectual property
  • Human remains or body parts
  • Pornographic materials
  • Items prohibited by law in origin or destination countries

4.3 Packaging Requirements

You are responsible for properly packaging your shipments. Packages must be securely sealed and able to withstand normal handling. We are not liable for damage resulting from inadequate packaging.

4.4 Declared Value and Insurance

You must accurately declare the value of your shipment contents. Optional insurance coverage is available for an additional fee. Without declared value coverage, our liability is limited as specified in Section 8.

5. Delivery Terms

5.1 Delivery Timeframes

Delivery timeframes are estimates and not guaranteed unless you have purchased a guaranteed delivery service. Delays may occur due to weather, customs clearance, incorrect addresses, or other circumstances beyond our control.

5.2 Delivery Attempts

We will make up to three (3) delivery attempts. If delivery cannot be completed, the package may be held at our facility for pickup or returned to sender. Additional fees may apply for redelivery or return.

5.3 Proof of Delivery

Delivery is confirmed by signature, photo evidence, or other verification methods. Delivery to the address provided constitutes fulfillment of our delivery obligation, even if the recipient is not the named addressee.

6. Pricing and Payment

6.1 Rates

Shipping rates are based on package weight, dimensions, origin, destination, and service type. We reserve the right to adjust rates at any time. Current rates are available on our website or upon request.

6.2 Payment Terms

We accept the following payment methods:

  • Mobile Money (MTN, Vodafone, AirtelTigo)
  • Credit/Debit Cards (Visa, Mastercard)
  • Bank Transfer
  • Cash (for select services)
  • Corporate Account (approved customers)

Payment is due at the time of shipment unless you have an approved credit account. Late payments may incur interest charges.

6.3 Additional Charges

Additional charges may apply for:

  • Address corrections
  • Redelivery attempts
  • Storage fees for unclaimed packages
  • Customs duties and taxes (international shipments)
  • Special handling requirements
  • Fuel surcharges

7. Customs and International Shipments

For international shipments, you are responsible for providing accurate customs documentation and ensuring compliance with import/export regulations. You agree to pay all applicable customs duties, taxes, and fees. Delays due to customs clearance are not the responsibility of Vindex Courier.

8. Liability Limitations

8.1 Maximum Liability

Unless you have purchased additional insurance, our liability for loss or damage is limited to:

  • Local Shipments: GHS 500 or the declared value, whichever is less
  • International Shipments: USD 100 or the declared value, whichever is less

8.2 Exclusions

We are not liable for:

  • Damage due to inadequate packaging
  • Delays beyond our control (weather, strikes, natural disasters)
  • Loss of business, profits, or consequential damages
  • Items shipped in violation of these Terms
  • Damage to fragile items not properly declared
  • Customs seizure or confiscation

9. Claims Procedure

To file a claim for loss or damage:

  • Notify us within 7 days of delivery (or expected delivery for lost items)
  • Provide the tracking number and shipment details
  • Submit photos of damaged items and packaging
  • Provide proof of value (receipts, invoices)
  • Retain all packaging materials for inspection

Claims will be processed within 30 business days. Approved claims will be paid via the original payment method or bank transfer.

10. Intellectual Property

All content on our website, including logos, text, graphics, and software, is the property of Vindex Courier and protected by intellectual property laws. You may not use, reproduce, or distribute our content without written permission.

11. Indemnification

You agree to indemnify and hold harmless Vindex Courier, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.
